These Terms and Conditions govern the relationship between the Seller, the artist Romana Šimáně, and the Customer when purchasing artworks, collectible prints, and ordering commissioned works through the website of Romana Šimáně.

(hereinafter referred to as the “Seller” or the “Artist”)
These Terms and Conditions apply to purchases and orders made through the Seller’s website.
2. Products and Services Offered
The website offers three basic forms of cooperation:
a) Original Artworks
Original paintings are presented in the
Portfolio section.
Original artworks cannot be purchased directly through the online shopping cart. Interested customers may request a personal viewing of a specific artwork by using the
“Arrange a Personal Viewing” button.
A purchase agreement is concluded on the basis of an individual agreement between the Artist and the Buyer, usually during a personal viewing of the artwork.
The method of payment, handover, or delivery of the original artwork is agreed individually depending on the specific artwork and the agreement with the Buyer.
By prior arrangement, the original artwork may be collected in person at the hotel where it is exhibited or at another location agreed in advance.
If the purchase agreement is concluded in person, it is not considered a contract concluded through the online store.
b) Collectible Prints
Collectible prints are offered through the online store.
The Customer selects a specific artwork and, where applicable, a print and frame option, adds the product to the shopping cart, and completes the order through the checkout process.
The price of each print is stated on the relevant product page.
Collectible prints are produced in limited editions. Each print is supplied with a certificate of authenticity.
The print is normally signed by the Artist on the reverse side. By prior arrangement, the print may also be signed and marked with its serial number on the front.
c) Commissioned Works
Commissioned works are created on the basis of an individual agreement between the Artist and the Customer.
The interested Customer submits an enquiry using the form available on the website. Based on the enquiry, the Artist discusses the specifications, scope of work, dimensions, price, completion date, and other conditions with the Customer.
A contract for work is concluded only after the specific specifications, price, and other conditions have been approved by both parties.
The price of a commissioned work is payable in two instalments:
- 50% of the agreed price before work begins,
- 50% of the agreed price upon delivery of the completed artwork.
The specific completion date and method of delivery are always part of the individual agreement.
3. Ordering Collectible Prints
The Customer places an order for a collectible print through the online store.
Before submitting the order, the Customer has the opportunity to review and amend the information provided in the order.
By submitting the order, the Customer confirms that the order entails an obligation to pay.
After submitting the order, the Customer receives an order confirmation at the e-mail address provided in the order.
The purchase agreement is concluded at the moment the order is confirmed by the Seller.
4. Price and Payment Terms
The price of each product is always stated on the relevant product page in the online store.
The shipping cost for collectible prints is:
CZK 500.
Personal collection at the hotel is free of charge.
Collectible prints may be paid for online using the payment methods available in the online store.
For personal collection, the order must be paid online in advance.
5. Framing of Collectible Prints
A collectible print may be ordered:
- without a frame, supplied in a protective tube,
- with a black matte frame,
- with a white matte frame.
Both available frames have a square profile, matte finish, and a visible width of 51 mm.
For framed versions, the canvas is permanently mounted onto a 5 mm Kapa board.
The Customer may also choose to purchase the print only, supplied in a tube, and have it framed separately according to their own preference.
6. Delivery and Collection of Collectible Prints
Framed collectible prints are generally dispatched within
10–14 days after receipt of payment.
The specific delivery date may be affected by the production of the frame or other circumstances on the part of suppliers. The Customer will be informed of any extension of the delivery period.
Prints are delivered to the address provided by the Customer in the order.
The shipping cost is CZK 500.
Personal collection at the hotel is available by prior arrangement and is free of charge.
Personal collection at the hotel is also available for original artworks and commissioned works, always subject to prior individual arrangement.
7. Right of Withdrawal for Collectible Prints
If the Customer is a consumer and the purchase agreement for a collectible print was concluded through the online store, the Customer has the right, in accordance with applicable legislation, to withdraw from the agreement within
14 days of receiving the goods.
Withdrawal may be notified to the Seller by e-mail at
atelier@romanasimane.art or by another demonstrable means.
Following withdrawal from the agreement, the Customer is required to return the goods to the Seller no later than 14 days after withdrawal, in the original packaging in which the goods were delivered to the Customer.
The Customer bears the cost of returning the goods.
The Seller shall refund the Customer all payments received, including the cost of the original delivery of the goods, to the extent required by law.
The Seller may withhold the refund until the returned goods have been received.
The Customer is liable for any reduction in the value of the goods resulting from handling the goods beyond what is necessary to establish their nature and characteristics.
8. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to works made according to the Customer’s specifications or customised to the Customer’s personal requirements, provided that the statutory conditions for this exception are met.
This provision applies in particular to individually commissioned works.
For original artworks, the manner in which the agreement is concluded is governed by the specific individual agreement between the Artist and the Buyer. If the agreement is concluded in person during the viewing and handover of the artwork, it is not considered a distance contract.
9. Complaints and Rights Arising from Defective Performance
The Customer’s rights arising from defective performance are governed by applicable legislation and by the separate Complaints Procedure published on the website.
The Customer may notify the Seller of a defect that becomes apparent within the statutory period. For consumer goods, this period is generally two years from the date of receipt.
Complaints shall be handled no later than 30 days from the date on which they are submitted, unless the Seller and the Customer agree on a longer period.

10. Copyright
All paintings, photographs, texts, graphic elements, and other content published on the website are protected by copyright.
By purchasing a physical artwork, the Customer acquires ownership of that specific physical artwork.
Purchasing an artwork does not grant the Customer the right to reproduce, copy, publish it for commercial purposes, or otherwise exercise any copyright relating to the artwork, unless otherwise agreed with the Artist in writing.
11. Personal Data Protection
The Buyer’s personal data is processed in accordance with applicable legislation and is described in detail in the
Privacy Policy available on the RomaArt website.
12. Alternative Dispute Resolution for Consumer Disputes
If a consumer dispute arises between the Seller and the Consumer and cannot be resolved by mutual agreement, the Consumer may submit a proposal for alternative dispute resolution to the Czech Trade Inspection Authority.

13. Personal Data Protection
Customers’ personal data is processed in accordance with applicable legislation and the Privacy Policy available on the website.
14. Final Provisions
These Terms and Conditions become effective on the date of their publication on the website.
The Seller is entitled to update these Terms and Conditions in response to changes in applicable legislation or changes in the operation of the website.
The current version of the Terms and Conditions is always published on the website.
