This Complaints Procedure governs the manner in which rights arising from defective performance may be exercised and handled in relation to artworks, collectible prints, and commissioned works by Romana Šimáně.
The Seller is responsible to the Customer for ensuring that the goods sold conform to the agreed characteristics at the time of receipt and are free from defects for which the Seller is liable under applicable legislation.
In the case of consumer contracts, the Customer may exercise rights arising from defects that become apparent within the statutory period. For goods, this period is generally assessed as two years from the date of receipt.
A complaint may be made particularly in the following cases:
Characteristics corresponding to the nature of an artwork shall not be considered defects, such as natural variations in colour, texture, or surface appearance caused by the artistic technique, materials used, or differences in display on various screens.
Collectible prints are properly inspected and packaged before dispatch.
If the Customer discovers visible damage to the shipment upon receipt, it is recommended that the damage be documented by taking photographs of both the packaging and the artwork itself and that the Seller be contacted without undue delay.
However, late notification in itself does not deprive the Customer of their statutory rights arising from defective performance.

For commissioned works, it is also advisable to specify the agreed requirements to which the complaint relates.
The Seller shall provide the Customer with confirmation of receipt of the complaint and subsequently with confirmation of the manner in which the complaint was resolved.
The complaint shall be handled without undue delay, no later than 30 days from the date on which it was submitted, unless the Seller and the Customer agree on a longer period.
The Customer shall be informed of the outcome of the complaint.
If the complaint is justified, the appropriate remedy shall be determined in accordance with applicable legislation and the nature of the specific defect.

In the case of commissioned works, particular consideration shall be given to whether the completed work conforms to the specifications agreed in advance between the Artist and the Customer.
Due to the individual nature of commissioned works, specific characteristics of the work may also be agreed upon, such as dimensions, colours, technique, materials, or method of execution.
Natural characteristics of a handmade artwork that correspond to the agreed specifications shall not in themselves constitute a defect.
In the event of a justified complaint, the Customer is entitled to reimbursement of reasonably incurred costs associated with making the complaint to the extent provided for by law.

Each painting is created as a unique original, and its atmosphere, texture, and the play of light are best experienced in person. By prior arrangement, I’d be happy to give you a tour of the “Path of Light” collection on display at the Nobilis Hotel and introduce you to other available original works. You can pick up your selected painting in person, or we can work together to choose a suitable shipping method. We always handle this on a case-by-case basis, taking into account the size of the artwork and its destination.
Each print is produced individually and, before dispatch, is signed, given a serial number (on the front of the print or on the back of the board, if framed) and accompanied by a certificate of authenticity. I will pack it carefully and dispatch it approximately 10–14 working days after receipt of payment. The price includes the cost of postage and secure packaging. By prior arrangement, it is also possible to collect the item in person from the Nobilis Hotel in Mladá Boleslav, where payment can be made in cash or via QR code.
I carefully pack each painting and ship it within 5 business days of receiving payment.
If the work is currently on display at the Nobilis Hotel, it must first be replaced with another painting. The delivery time is therefore longer ‑ up to 30 days.
You can also pick up the painting in person, either directly at the Nobilis Hotel or at my place in Mladá Boleslav ‑ Bradlec, by prior arrangement.
Shipping, packaging, and insurance are charged at CZK 800.
